Across the UK, IRN Research estimate that over £3 billion was paid out in clinical negligence (CN) cases in 2021/22, most of this by public sector health bodies, via the main public indemnity organisations or directly by departments for health and public health organisations. The amount spent rose by around 5% in 2021/22 compared with 2020/21. The key factors behind the growth were:
- A rebound in case settlement numbers in 2021, after the initial impact of COVID hit the market in 2020
- An increase in the highest value cases going through the High Court
In 2021/22, IRN estimate law firms earned revenue of over £1 billion from CN cases, with revenues up by 8% over the previous year. This is a gross estimate of law firm income. Against this must be set the costs of running the cases law firms have lost. Taking these costs into account means in 2021/22, law firms earned just over £900 million net on CN cases, virtually unchanged on the figure in the previous year.
